Terms of Use

4.1 Available Plans

We offer different subscription plans (Indie, Startup, Scale) with different features and limits. You can see the details of each plan on our pricing page.

4.2 Billing and Payment

• Paid plans are billed monthly, unless otherwise specified
• Charges are processed automatically at the beginning of each billing period
• You authorize automatic debit on the provided payment method
• All amounts are in US dollars (USD) and do not include applicable taxes
• You are responsible for providing valid payment information and keeping it up to date

4.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period, unless you cancel before the renewal date. You can cancel at any time through the settings panel.

4.4 Refunds

We do not offer refunds for partially used billing periods. If you cancel your subscription, it will remain active until the end of the already paid period. After cancellation, your account will be automatically converted to the free Indie plan.

4.5 Price Changes

We reserve the right to modify our prices at any time. You will be notified at least 30 days in advance of any price increase. Continued use of the Service after the price change constitutes your agreement to the new price.

6.1 Service Ownership

The Service and its original content, features, and functionality are and will remain the exclusive property of Probecast and its licensors. The Service is protected by copyright, trademark, and other laws.

6.2 Your Data

You retain all rights to the data you upload or generate through the Service. By using the Service, you grant us a limited, non-exclusive, and revocable license to process, store, and display your data only to provide the Service to you.

6.3 Feedback

Any feedback, comments, or suggestions you provide about the Service may be used by us without any obligation of compensation or attribution.

7.1 Warranties

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

7.2 Limitation of Damages

UNDER NO CIRCUMSTANCES WILL PROBECAST, ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Business interruption or loss of opportunities
• Damages resulting from unauthorized access to your data

7.3 Maximum Limit

Our maximum total liability for any claim under these Terms will not exceed the amount you paid to Probecast in the 12 months prior to the claim.

7.4 Third-Party Monitoring

We are not responsible for the availability, performance, or content of third-party services that you monitor. You are responsible for ensuring that you have authorization to monitor those services.

8.1 By You

You may cancel your account at any time through the dashboard settings. Cancellation takes effect at the end of the current billing period.

8.2 By Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms or our Acceptable Use Policy
• Your payment fails or your account is overdue
• We detect fraudulent or abusive activity
• We are required by law or court order
• We discontinue the Service (with 30 days notice)

8.3 Effect of Termination

Upon account termination, your right to use the Service will cease immediately. You may request a copy of your data within 30 days after termination. After that period, all your data will be permanently deleted, according to our Privacy Policy.

9.1 Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on the Service. Continued use of the Service after the changes constitutes your acceptance of the new Terms.

9.2 Governing Law and Jurisdiction

These Terms will be governed and interpreted in accordance with the laws of Brazil, without regard to its conflict of law provisions. Any dispute related to these Terms will be resolved in the competent courts of Brazil.

9.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

9.4 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Probecast regarding the use of the Service.

9.5 Waiver

Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
